This week saw us deliver an open letter to Caroline Dinenage, Minister of State for Care and Kelly Tolhurst MP, BEIS, signed by 17 representative bodies within Social Care.
It has been 3 months since the decision was announced in respect of the Royal Mencap V Tomlinson-Blake appeal case and yet radio silence continues. In a tweet this afternoon (5 October), Matt Wort of Anthony Collins Solicitors also announced that the Supreme Court had indicated it would be likely after the New Year before they decide whether to grant UNISON leave to appeal.
Granted, there have been some murmurings from HMRC but that is all, nothing that helps pave the way for a clear understanding and determination of how staff should be remunerated. The impact of this is multi-faceted and the Government needs to act. We are asking the Government to revise guidance and give commissioners, employers and staff the clarity they need and deserve.
