The Disclosure and Barring Service have today (27 February 2013) announced that the Home Secretary and Secretary of State for Justice have recently lodged an application to appeal against the judgment, where all old and minor convictions and cautions appear on disclosure certificates, which the Court found was a breach of human rights.

The Court of Appeal’s judgment has been temporarily suspended pending the Supreme Court’s decision on the appeal application.

While this suspension is in force, it is still business as usual for the Disclosure and Barring Service and they will continue to issue Standard and Enhanced certificates and these will show all convictions and cautions as normal.
